Petitioner Name s/oName R/O Location seeks release of his Repeater 12 bore No.14615936 with fitted and spare
magazine with 16 rounds on superdari,
being seized by the local police in case vide FIR No. 653 dated 25-12-2021 u/s
15AA PPC of P.S location name.
Arguments heard and record perused.
Perusal of the record reveals that the weapon in question has been taken into possession by local police in the above mentioned case. The petitioner is licensee of the weapon in question. In this regard he produced licenses (Original seen and returned while copy retain on file). There is no rival claimant of the same. The case property is also no more required to the local police for further investigation. There is strong apprehension of deterioration of the weapon in question if remained in the custody of local police, which is not permissible under the law. Over and above superdari is an interim arrangement for custody of case property in order to save it from deterioration.
For
the foregoing reasons, the application of superdari is allowed and the weapon
alongwith 16 rounds be returned on superdari to the petitioner, if he furnishes
bail bonds to the tune of Rs. 30,000/- with two sureties each in the like
amount to the entire satisfaction of SHO concerned subject to verification of
licence, if weapon is not required in any other case. However, this order shall
have no baring upon any criminal liability on petitioner. Petitioner is directed not to dispose of the
weapon in question till disposal of the case. He shall also be bound to produce
case property as and when required to the local police or the court.
Requisitioned
record be returned to quarter concerned while file of this court be consigned
to record room after its completion and compilation. Copy of this order be
placed on Judicial/police file.
