Present: SPP for the State. Petitioner with Learned Counsel Mr. Name location name.

                        Petitioner Name s/o father name seeks the release of his Tanker bearing Registration No. TLR-430 Chasis NO. FMIJKPT-14149, engine NO. JO8C-TGM-14521 and model 2010 alongwith key etc on Superdari, being seized by the local police in case FIR No. 180 dated 11/06/2022 registered U/S 279/337G/427 PPC in P.S location of District.

                        Arguments heard and record perused.

                        Perusal of the available record reveals that vehicle in question was taken into possession in the above mentioned case by the local police vide recovery memo dated 11-06-2022.  He produced the original registration copy, (original seen and returned while copy placed on file), which testified the ownership of the petitioner. Similarly there is no rival claimant of the same. There is also strong apprehension of deterioration of the vehicle in question if remain kept in the custody of local police for indefinite period of time, which is not warranted under the law.

                        For the foregoing reasons, the application of Superdari is allowed and the vehicle alongwith its accessories is re turned on Superdari to the petitioner, subject to furnishing of bail bonds in the sum of Rs.10,00,0000/- (one Crore) along with two local and reliable sureties each in the like amount to the satisfaction of SHO concerned. The petitioner is liable to produce the same as and when required by the court / local police. 

                        File be consigned to record room after its completion and compilation while requisitioned record returned to the quarter concerned.
